First of all, what is an asset recovery agency?
There are different names or titles used when it comes to this specific type of service. And that’s basically what “this” is, a service. Names may vary from “asset recovery agency” or “asset recovery specialist” to “surplus recovery agent” or “surplus specialist”. These agencies or specialists all do the same thing, provide a service in recovering excess funds or in some cases called surplus funds. The services that are provided may and will be different between states due to each state having their own laws and processes. What is excess or surplus funds?
There are different ways excess or surplus funds come about. Again processes may and will vary between states. One of the ways this happens is from the sale of a property at a foreclosure auction. When a sale is made at these auctions, the money collected from the highest bidder goes first to pay off any liens or parties with interest in the property. For example: let’s say John owed 200K on his home to ABC bank for a mortgage he took out on the home. The home goes to foreclosure auction and sells for 500k. ABC bank will get the 200k owed to them first, the remaining 300k is rightfully owed to the owner of the foreclosed property. Which in this example would be John, this 300k would be the excess or surplus funds we are referring to.
